ON-LINE PURCHASE CONDITIONS

All purchases made through the portal www.ardearte.es (hereinafter, the Web), property of AR DE ARTE, are subject to the general conditions contained in the legal notice. The General Conditions prevail over the On-line Purchase Conditions.

All products are subject to the following conditions. By purchasing on the Web, you automatically accept these conditions. Please read them carefully.

These terms and conditions constitute the entire agreement between the parties with respect to on-line transactions between AR DE ARTE and its clients.

AR DE ARTE is entitled to unilaterally modify each and every one of the obligations set forth in these conditions, without prior notice. Likewise, it is empowered to restructure, modify or eliminate any information, service or content included in the Web, without prior notice.

A purchase is not final until it is accepted by AR DE ARTE. AR DE ARTE reserves the right of admission and cancellation of any order, being able to return the amount paid by the customer and being exempt from any other obligation.

The website does not require prior subscription for simple browsing, access or use of the service in question.

PRODUCTS

The information provided shall at no time be considered either complete or exhaustive due to the wide range of products existing in the sector. AR DE ARTE, for its part, will try as far as possible to constantly update the prices of the products.

AR DE ARTE declares that the product offered usually corresponds to the photograph and technical description of the same. However, it is exonerated from liability for those cases in which, due to technical or human error, there are mistakes or variations between the photograph, the technical description and the price. Likewise, it is made clear that the photographs are merely indicative and there may be variations in terms of physical appearance but without undermining the integrity and performance of the product ordered.

AR DE ARTE is exonerated from the contents, information, opinions or comments disseminated through the Web, nor will it be responsible for the use that the User makes of this information.

We remind you that the sale of alcoholic beverages to minors under the age of 18 is prohibited. In order to purchase alcoholic beverages, it will be compulsory to register in order to check that the user is a person with the capacity to contract.

PRICE LIST

The price of the products is in EUROS and includes the taxes of Law according to the Spanish Legislation. The final purchase summary shows the final or total price of the purchase, indicating the amount corresponding to the price of the specific product and the amount corresponding to the applicable taxes.

Based on its commercial policy, AR DE ARTE may make final price variations either by loyalty, by acquisition of products of a certain entity or relevance as well as others that AR DE ARTE may stipulate in due course. However, it will be AR DE ARTE who freely and voluntarily offers these discounts and / or rebates to those it deems appropriate, not being able to be demanded or requested at any time by the customer.

Prices do not include shipping costs. Prices are valid except for typographical errors. All sales are made with the corresponding invoice. The products are available for sale while stocks last.

The prices shown may be revised and modified at any time by AR DE ARTE.

Once payment has been verified, AR DE ARTE will start processing the order.

PAYMENT METHODS

Once you have selected the products you must click on “View cart” and go to Shipping and Payment. In this part, you will have to specify if you want the order to be sent to your registered address or to a different one, and then make the payment according to the chosen method, by clicking on “Finalize purchase”. Once the payment has been completed, you will see the order registration confirmation and you will immediately receive this confirmation by e-mail.

The invoice will be issued, with the data provided, once the payment of the order has been confirmed and the order has been received and managed.

BANK TRANSFER

Upon completion of the order request, you will receive an e-mail with the total amount of the order and the account number to make the transfer.

In the transfer you must indicate the order number specified in the order request email.

It is important that you make the transfer within 3 days of placing the order, to prevent your order from expiring.

The order will not be considered effective until AR DE ARTE can effectively verify that the payment has been made. If you wish to speed up the process, you can send us the receipt of the transfer by e-mail to info@ardearte.es.

Remember that all possible exchange and bank commissions are your responsibility when you choose this payment system.

CREDIT CARD

In order to provide greater security for credit card owners, we have included a three-digit number on our credit cards called CSC which serves as an identification code to verify the physical presence of the card during Internet transactions. This three-digit number is printed on the back of your card (in the signature area), immediately after the card number. In order to prevent fraudulent credit card transactions, AR DE ARTE reserves the right to ask its customers for these check digits before sending the order.

Credit card fraud is a criminal offence, and AR DE ARTE will prosecute anyone who makes a fraudulent transaction in our online shop.

AR DE ARTE follows up on each transaction and will use all means available by law to ensure that those who make fraudulent purchases are punished by the authorities.

SHIPPING

AR DE ARTE will not ship any product until the Administration Department has verified that payment has been made.

Delivery will be considered to have been made when the carrier has placed the products at the customer’s disposal and the customer has signed the delivery receipt document. It is the customer’s responsibility to check the products on receipt and to state any reservations and complaints that may be justified in the delivery receipt document.

AR DE ARTE will send the products by the means it deems appropriate to fulfil its commitments.

SHIPPING COSTS

A delivery charge will be applied depending on the selected delivery area. However, AR DE ARTE RESERVES THE RIGHT TO REQUEST AN ADDITIONAL AMOUNT for particularly heavy or bulky orders. If this happens and the customer is not interested in formalising the order with the indicated delivery costs, the amount paid will be refunded and the order will be cancelled. AR DE ARTE will be exempt from any other commitment or obligation to the customer.

Products are shipped to mainland Spain. For shipments to Portugal, Canary Islands, Balearic Islands, Ceuta/Melilla and the rest of Europe, please contact via e-mail to calculate rates.

Orders over 60€ will be shipped free of charge.

Delivery time

Generally, an order is dispatched the next working day for those orders for which proof of payment has been sent to us before 12:00 noon. If proof of payment is sent after this time, two working days later. Delivery at destination will be made depending on the destination area. AR DE ARTE does not commit itself to any specific delivery time, as the shipping process depends on third parties.

GUARANTEE

The products do not have additional guarantees as they are exquisite products, handmade, and perishable, i.e., for immediate consumption, so the freshness and good condition of the same at the time of delivery is guaranteed, but AR DE ARTE is not responsible for the conservation, treatment or distribution that the customer or user can give to them once delivered.

RIGHT OF WITHDRAWAL AND RETURNS

How to exercise the right of withdrawal: To exercise the right of withdrawal with respect to products purchased exclusively on the Web, you must express your unequivocal decision to withdraw from the contract, within 14 calendar days, in one of the following ways:

  • If you choose the option of returning the product through the online shop of the Website, you must contact our Customer Service Department by telephone on 627954649, or via the email account info@ardearte.es to unequivocally state your decision to withdraw from the contract.

Without prejudice to the provisions of the preceding paragraphs, you may also choose to exercise your right of withdrawal by completing and sending electronically to the email account info@ardearte.es the withdrawal form that you can download , in which case, we will inform you promptly by email of the receipt of such withdrawal.

The right of withdrawal shall be deemed to have been exercised within the deadline when you have sent us the communication concerning the exercise of this right before the end of the corresponding deadline, in the terms indicated above.

Consequences of withdrawal: If you exercise your right of withdrawal, we will reimburse to you all payments we have received from you, excluding delivery charges, without undue delay and in any event not later than 14 calendar days from the date on which you inform us of your decision to withdraw from the contract. We will proceed to effect such reimbursement using the same means of payment in which the purchase was paid for without you incurring any costs as a result of the reimbursement except for the costs of returning the product. In all cases, the products to be returned must be in perfect condition, in their original packaging and accessories or promotional gifts, if applicable, included. If this is not the case, the withdrawal cannot be exercised.

COMPLAINTS SHEET

There are complaint forms available to the customer. The form can be requested from our customer service department by telephone or by e-mail, and we will send it to the address you indicate. You can also request it in our establishments, in the shop at COBRE S/N. VIVEIRO DE EMPRESAS. OFFICE 3ºI. POLYGON OF BÉRTOA. 15105 – CARBALLO (A CORUÑA).

In addition, “The European Commission provides an online dispute resolution platform which is available at the following link: http://ec.europa.eu/consumers/odr/. Consumers may submit their complaints through the online dispute resolution platform”.

JURISDICTION, VENUE AND LAW

The parties submit to the courts and tribunals of the domicile of AR DE ARTE for the resolution of disputes, renouncing any other jurisdiction.
